Purpose

This document sets out the general terms of use of the tevsys.io website and the tevsys™ product (utility / Expert Advisor for MetaTrader 5). It complements the operational description on How it works (including Monitoring: what tevsys covers — and what it does not).

Nature of the product

tevsys is a local utility for risk management and operational discipline. It enforces the limits and rules you configure (daily and/or weekly loss and gain limits, OFF days, lock when a limit is reached, and optional layers by plan). It executes automatic closes according to that agreement.

It does not trade on the user’s behalf, does not issue trading signals, does not manage buy/sell strategies, does not custody funds and does not constitute financial, investment or trading advice.

User responsibility

The user is solely responsible for configuring their limits, for their trading decisions and for the results of using the product. tevsys enforces what the user configures; the decision is always theirs. The execution environment (MetaTrader 5, broker, network, VPS or computer) is the user’s responsibility.

Scope of monitoring

Tick-by-tick monitoring (evaluating limits and sending closes) only exists while MetaTrader 5 and tevsys are running on a machine with market access (home PC or VPS). That is not a hidden product failure: it is how a program that runs inside the terminal works.

If MetaTrader is closed, the machine is powered off with no other active terminal, or tevsys is removed from the chart, live monitoring is paused. The agreement state (limits, lock, protection snapshot) may remain stored; when you reload, tevsys reattaches with those same percentages — not as a fake “free” panel. Market execution

When a configured limit is reached, tevsys processes and sends the close order to the broker through MetaTrader 5. The final fill price and outcome are determined by the market and the broker (slippage, spread, liquidity, gaps, first tick when quoting resumes, network latency).

tevsys cannot force an exact price on market orders. Where the product documents it, the record separates the tevsys decision (limit trigger) from MT5 execution. Published precision figures (e.g. average error under normal conditions) are not a guarantee of outcome on every trade; extreme cases are documented separately.

HyperClose and trading while locked

If, with active protection or on an OFF day as configured, the user tries to open new trades, HyperClose may immediately close that new exposure and log the attempt. Insisting on trading while locked means accepting the cost and risk of those attempts. MetaTrader stays open: tevsys does not “turn off” the terminal.

Evidence and records

tevsys may generate logs and records that can be checked against official MetaTrader 5 reports for the same period. That evidence helps verify compliance and event sequence; it is not a broker-audit service, a profit guarantee, or a legal/regulatory opinion.

Limitation of liability

To the extent permitted by applicable law, tevsys™ and its rights holders are not liable for loss or damage arising from: broker or network slippage or delays; market gaps; MetaTrader 5, VPS or broker server outages, updates or shutdowns; use without active monitoring (gaps with no terminal); incorrect limit configuration by the user; or insisting on trading while locked.

Unless mandatory law provides otherwise, any financial liability related to use of the software is limited, at most, to the amount paid for the licence in the relevant period. This clause will be reviewed and formalized with professional legal advice.
